​Terms & Conditions

​Effective Date: 1 February 2025

1. Introduction
These Terms & Conditions ("Agreement") govern the provision of services ("Services") by UNTAMED Creative Society PTY LTD ("UNTAMED", "we", "us", or "our") to the client ("Client", "you", "your") who subscribes to UNTAMED's Content That Converts subscription service, either on a Basic or Standard plan. By signing up for the Services, you agree to be bound by these Terms & Conditions.

2. Services Provided
UNTAMED will provide the following services based on the plan selected by the Client:


Basic Plan:

  • 1 Project

  • Commercial Collateral: Pitch Decks | One-Pagers | Sales Enablement

  • Social Media Collateral: Up to 12 Posts

  • Digital Event Collateral

  • Podcast: 1 Full Episode Edit | +- 3 Snippets Promos

  • Copywriting: +- 4 Newsletters or Articles

 

Standard Plan:

  • Everything in the Basic Plan, plus:

  • Brand & Rebranding Design

  • Print & Advertising Design

  • Packaging & Presentation Design

  • Video Editing

3. Subscription and Payment Terms

  • Billing Cycle: Clients can choose either a monthly or annual billing cycle. The monthly subscription is billed on a recurring monthly basis, while the annual subscription is billed once per year.

  • Pricing: The subscription fees are as follows:

    • Basic Plan: £699/month (1 concurrent project)

    • Standard Plan: £1,499/month (3 concurrent projects)

  • Payment Method: Payments are processed on a recurring basis, billed at the beginning of each month.

  • Late Payments: If payment is not made on time, UNTAMED reserves the right to suspend services until payment is received. Late payments will incur a 10% late fee for each 30 days overdue.

 

 

4. Client Responsibilities

  • Content Submission: The Client agrees to provide all necessary assets, brand guidelines, and approvals required to create content in a timely manner.

  • Access to Team: The Client agrees to provide necessary access to the relevant team members and stakeholders for alignment and feedback.

  • Communication: The Client is responsible for maintaining open communication with UNTAMED and responding promptly to requests for information and feedback.

 

 

5. Service Level Agreement (SLA)

  • Content Delivery: UNTAMED will provide content within the agreed-upon timelines for each content piece (usually 24-48 hours).

  • Revisions: All subscription plans include unlimited revisions, but excessive revisions or scope changes beyond the initial agreement may incur additional charges.

  • Support: UNTAMED provides ongoing support during business hours and will respond to any inquiries or requests within 24 hours.

 

 

6. Intellectual Property Rights

  • Ownership: The Client owns the final content produced by UNTAMED once payment has been received in full. UNTAMED retains the right to use the work in its portfolio, case studies, and marketing materials.

  • Licensing: UNTAMED grants the Client a non-exclusive, worldwide license to use the content for its intended purposes, subject to payment of the subscription fees.

 

 

7. Termination

  • Cancellation: Either party may cancel this Agreement with one month’s notice. The Client will be billed for the services provided up to the cancellation date.

  • No Refunds: UNTAMED does not provide refunds for payments made, but the Client will receive services for the full term of the paid subscription.

  • Breaches: If the Client breaches any terms of this Agreement, UNTAMED may terminate the Agreement immediately.

 

 

8. Liability
UNTAMED will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the content. UNTAMED’s total liability is limited to the amount paid by the Client for the subscription service within the last 12 months.

9. Confidentiality
Both parties agree to keep all proprietary information confidential and not disclose it to third parties, except as required by law.

 

 

10. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the issue through mediation or arbitration before resorting to legal action.

 

 

11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions.

 

 

12. Modifications
UNTAMED reserves the right to modify this Agreement at any time. Any changes will be communicated to the Client and will be effective immediately unless otherwise stated.
